the agreement

the following document is an agreement between manuel aicher and an heir. it represents the current standard version of our contract which is regularly updated according to the latest legal decisions and legislation. due to changes there may be different versions and even specific variations of agreements

this is the wording of the agreement:

Memorandum of Agreement
Between

Client’s full name and address

(hereinafter called entitled person) of the one part and

(hereinafter called agent) of the other part

whereby is mutually agreed as follows regarding the inheritance of name of decedent

1. The agent has made successful efforts in locating and notifying the entitled person that there are unclaimed assets and or monies which he is entitled to. He admits that he was informed about these claims for the first time by the agent.

2. Besides the efforts hitherto the agent is obliged to

2.1. research all possible genealogical relationships not cleared up to now and all missing dates in order to pursue the above mentioned claims before the probate court orderly,

2.2. to provide the documents necessary therefore,

2.3. to engage and pay an attorney as far as it is necessary to pursue the above mentioned claims.

3. The entitled person hereby states that the agent has made no representations to him of amounts to which he might be entitled and have only told him that he has located him and that he has knowledge of unclaimed assets and or monies which he is entitled to.

4. The entitled person is aware that he can try himself to determine on his own what he is entitled to, but in consideration of the agent locating him and agreeing to do all the work associated with receiving the unclaimed assets and or monies, the entitled person knowingly and voluntarily assigns herewith x % (x percent) to the agent as his fee. This fee is due from the amount before deduction of probate duty. Value added tax for this fee, as far as it has to be paid by the agents, has to be added.

5. The agent is authorized to claim his commission directly from the engaged attorney or from the executor.

6. The fee is only due if and as far as the entitled person gets any assets and or monies from this inheritance. If the entitled person should not get any assets and or monies from this inheritance, no matter why, there are no costs and no obligations incurred by the entitled person. Advance payments do not have to be made.
